If you suffer a work-related injury, you should not rely on your employer and its insurance carrier for help in claiming benefits. Enlist an experienced workers’ comp attorney as an essential and valuable teammate on your side who understands the Pennsylvania Workers’ Compensation Act, and all of its associated regulations. You must evaluate an attorney’s knowledge of the law and experience litigating workers’ compensation claims.

Pennsylvania state law requires almost all Pennsylvania employers to carry and provide workers’ compensation insurance. Coverage includes all medical expenses related to a work injury commencing with any costs incurred on the first day of an injury and all future costs.

Wage-loss benefits are typically paid in the form of a percentage portion of wages while a claimant is unable to work, starting on the eighth day after the day of the injury. The first seven days are paid after a worker misses 14 days of work. It may take up to 21 days for a worker to receive any initial benefits even if the worker notified her employer of the injury immediately after the accident occurred.

Benefits are calculated based on the average amount of a worker’s weekly wage at typically two-thirds of this amount and may be offset by Social Security benefits, severance pay and other income.
