How Are Personal Injury Lawyers Paid?

How Are Personal Injury Lawyers Paid?Powell Law does not charge prospective personal injury clients a fee for a consultation at Powell Law because we take cases on a contingency fee basis, where the fee is contingent on the outcome. In a contingent fee arrangement, we agree to accept a fixed percentage of a client’s recovery, which is the amount finally paid to the client. If we win the case and the court awards damages, our legal fee is paid from this cash award. If the case is lost, neither our client, the plaintiff, or Powell Law will receive any money for fees, but our client will not be required to pay us for our work in litigating the case.

The fee will be a percentage of the recovery and is typically 33 to 40 percent based on whether the case settles or goes to trial. However, clients are required, win or lose, to pay the costs of the case. These costs include:

  • Copies of records and reports;
  • Photocopies and other office expenses;
  • Legal research costs;
  • Court costs, such as filing fees;
  • Fees for depositions; and
  • Fees for investigators and expert witnesses.
