The Rights Of Nursing Home Residents: Miscellaneous Rights
Nursing
home residents have several rights under Federal and Pennsylvania law. These
rights include rights such as the right to make personal choices regarding
medical treatment and daily personal routine. Other assorted rights include the
right to be informed regarding circumstances involving the facility and, more
importantly, the right to be informed of personal information such as medical
condition and medications. Nursing home residents also have the right to
freedom of association, and the right to practice religion.
Choice
Residents have the right to see the doctor of their
choice and the right to refuse treatments and medications.
Residents have the right to choose their schedule of
activities based on their personal preferences.
Informed
Residents have the right to be informed in writing
about services and fees before entering the nursing home facility.
Residents have the right to be informed about their medical
condition and medications.
Residents must be informed of the rules of the nursing
care facility and receive 30 days written notice prior to the effective
date of a new institutional rule.
Association
Nursing home residents who are married may room together unless medically
contraindicated;
A nursing home resident has the right to freely and
privately associate, organize and communicate with others;
A nursing home resident has the right to
communicate privately with and access the local ombudsman;
A nursing
home resident is free to communicate and
meet privately with anyone, including family, resident groups and the local
ombudsman.
Religion
A nursing home resident has the right to
practice the religion or faith of his or her choice, or not to practice any
religion or faith.
